1. UAE Legal Liability — You Cannot Outsource Safety
Under UAE Federal Decree-Law No. 33 of 2021, the main contractor is jointly liable for the safety of every worker on the site, regardless of who employs them. 'I did not know what my subcontractor was doing' is not a legal defence. Criminal, civil and regulatory exposure (MOHRE, ADOSH-SF (formerly OSHAD), Dubai Municipality, Trakhees) sits with the main contractor site management, not just the subcontractor foreman. You can outsource the work; you cannot outsource the duty of care.
2. HSE Pre-Qualification
Assess BEFORE contract award: valid UAE trade licence and MOHRE registration; workers' compensation insurance; documented HSE policy and management system; last 3 years' incident data (TRIR, LTIFR, fatalities) and evidence of closed CAPAs; competent HSE resource ratio; sample MSRAs/method statements; PPE and training records. A fatality in the last 2 years without a completed investigation and verified CAPAs is a disqualification, not a discussion.
3. Onboarding — Four Requirements Before Anyone Starts Work
Before any subcontractor worker enters a work area: (1) site safety induction covering layout, zero-tolerance rules, emergency plan, PPE and PTW; (2) MSRA for the task reviewed and approved in writing by the main contractor's HSE officer; (3) PTW briefing with the issuer and holder; (4) subcontractor HSE plan for their scope submitted and accepted. Missing any of the four = no work.
4. Daily & Weekly Monitoring
Daily: gate PPE checks, PTW walk-downs, MSRA vs actual method spot-checks, near-miss follow-up. Weekly: subcontractor safety meeting, KPI review (PTW compliance %, open NCRs, near-miss reports, training compliance), trend review. Keep a live compliance register with status per subcontractor. What you inspect is what you get; what you ignore is what you accept.
5. Non-Conformance, Stop-Work and Removal
Issue a written NCR for any breach with owner, corrective action and due date. Trigger stop-work when a control is missing, bypassed, or the risk is imminent. Grounds for immediate removal from site include: a worker killed or seriously injured due to the subcontractor's safety failures; refusal to comply with a stop-work order; repeated failure to close NCRs; or falsification of records. Removal requires a written Notice of Removal, close-out inspection, MOHRE notification where applicable, and 5-year documentation retention. Follow the contract terms — get legal sign-off if unclear.
6. The Partnership Approach
Compliance-only produces compliance when watched and concealment when not — zero near-miss reports is a warning sign, not a badge. A partnership approach includes subcontractor supervisors in weekly safety meetings, shares near-miss learnings across all teams, celebrates subcontractor safety wins publicly, and treats non-compliance as a system problem to solve together. Compliance is the floor; culture is the ceiling.
