Module Content

1. Why Just Culture

A pure blame culture drives incidents underground: workers hide near-misses and small injuries, so the organisation never learns. A pure no-blame culture protects reckless individuals and demoralises the majority who work safely. Just Culture sits between: it holds the system accountable for design and support, and holds individuals accountable for choices — but only after asking the right questions.

2. The Three Categories

Human error: an unintended slip, lapse or mistake by a competent worker following the process — response is CONSOLE. At-risk behaviour: a conscious choice to deviate, where the worker did not perceive the risk as significant — response is COACH. Reckless behaviour: a conscious disregard of a known and substantial risk — response is DISCIPLINE.

3. The Substitution Test

Before disciplining, ask: would three competent peers, in the same situation, with the same training, tools and time pressure, likely have made the same choice? If yes, the issue is systemic — fix the system. If no, and the individual knew the risk was substantial, discipline is fair. Apply the test to leaders on their own decisions too.

4. Response by Category

Console: acknowledge the error, review the design (was the task set up to fail?), retrain if a knowledge gap exists, no sanction. Coach: private conversation, agree the safe method, document, follow up in 30 days. Discipline: follow the UAE-compliant progressive scheme — verbal warning, written warning, final warning, termination — with the worker's right to respond at each step.

5. UAE Labour-Law Limits

Under Federal Decree-Law No. 33 of 2021 and Cabinet Resolution No. 1 of 2022: fines cannot exceed 5 days' wages per month; suspension without pay cannot exceed 14 days per infraction; the worker must be notified in writing of the allegation and given a chance to respond; termination for serious safety violations requires documented investigation. Deportation as a threat is illegal and voids the scheme.

6. Post-Incident Behaviour Review

In every incident investigation, run the behaviour review separately from the root cause analysis. Ask: what did the person do, what did they intend, what did they know, what would peers have done. Publish only the anonymised lesson — never the individual's name — and share the discipline outcome (if any) only with those who need to know.
