Statutory liability and sanctions under UAE law for a PMC engineer who signs off an NCR closure that cannot be supported by evidence: civil liability under the 2026 Civil Code, decennial exposure, the forgery and cybercrime provisions, corporate liability, Dubai licensing sanctions, limitation, insurance, twelve safeguards and the steps to take if a false closure is discovered.

Ready-to-issue formal letters for the three-notice escalation package: the Formal Warning, the Notice to Correct under Sub-Clause 15.1, and the Notification of Subsequent Action, with an Employer's Claim notice and a withholding notice as annexes, an escalation ladder, an issue checklist and UAE-specific tailoring notes.
Download .docx View .pdfClosed NCR retrospective audit protocol (Word)
A 14-step protocol for auditing previously closed NCRs against decennial liability: five phases and four gates, a risk-scoring and tiering model, sampling rules, evidence sufficiency matrices by NCR type, physical test method selection, forensic red-flag indicators, a disposition and action matrix, the 5 Whys and SMART CAPA template, the retrospective closure certificate, the ten-year dossier index and KPIs. Works with workbook sheets 16 to 18.
Download .docx View .pdfRisk automation pack (SQL, runner and flags)
Instant flagging of high-risk NCRs across all five project phases. Sheet 19 of the workbook scores and flags every item as it is typed; the SQL pack holds 30 documented queries (Q-00 to Q-99) covering permits, construction, commissioning, handover and the decennial period; the Python runner loads the workbook into a database and writes a report with one tab per query plus the daily critical list. The guide explains the scoring model, the runbook and how the retrospective closure certificate defends a decennial claim.

|---|---|
| Part A - Understanding | Definitions of the observation and the non-conformance, a 22-point side-by-side comparison, the terminology conflicts that cause arguments on UAE sites (SOR as Site or Safety Observation Report, NCR versus Notice to Correct, snag versus defect), the FIDIC clause map, and the point at which a quality record must become a separate contractual notice. |
| Part B - Application | Who may issue what, triage decision rules, the mandatory form fields, numbering and EDMS conventions, service levels, NCR classification, root cause and CAPA requirements, the standard of proof for closure by technical category, reporting and escalation limits, and the prohibitions. Then the contractor-side playbook and the client-side proof chapter, including the evidence hierarchy, the closure dossier, the closure certificate, KPIs and traceability. |
| Part C - UAE authorities | A 70-authority matrix across the federal layer, Dubai, Abu Dhabi, Sharjah, Ajman and Umm Al Quwain, Ras Al Khaimah and Fujairah, and the utilities, telecom, road and infrastructure custodians. Per-emirate completion sequences, the codes that create obligations, authority-linked evidence packages, and the status model for authority items. |
| Part D - Implementation | 30, 60 and 90 day roadmap, RACI, failure modes and controls, references, and appendices with the SOR form, NCR form, closure certificate, evidence naming convention and glossary. |
| Appendix F - Field aid | The one-page major NCR close-out aid, reproduced for inclusion in the article and for printing separately. |
| Appendix G - Enforcement | Contract clauses used to enforce closure under FIDIC 2017 and 1999, what each notice must contain, the hard contractual time bars, the recommended project timeline discipline, the statutory layer showing what each UAE authority can withhold, the three-notice escalation package with indicative wording, and the practices the PMC must avoid. |
Using the workbook
- Start on the Dashboard sheet and enter the project, contract, parties and the response periods once. The print-ready forms load those fields automatically.
- Log findings in the SOR Register and NCR Register. Ageing, overdue flags and status are calculated, so do not overwrite the grey columns.
- Use the KPI Dashboard for the monthly assurance pack; enter the reporting year in cell C4 to drive the trend chart.
- Give the Major NCR Checklist sheet to the contractor's QA/QC team, and keep the printed Field Aid in the site office.
- Adapt the Authority Matrix sheet to the plot: confirm the permit issuer, the applicable conditions and the instrument that will prove closure.
Important notes
The FIDIC clause numbers quoted are indicative. Numbering, wording and time periods change between the 1999 and 2017 editions and are frequently amended by Particular Conditions; the executed contract always prevails. Any clause reference used in an NCR, instruction or notice must be verified against the project contract documents first.
Authority service routes, certificate titles and procedures change. Where an instrument could not be confirmed from a public source, the material states verify current requirement, and the project team should confirm the live permit matrix and service channel with the authority.
